The terms between you and Red Timbers Hospitality Ltd when you use this website, stay here, eat here or enter the gaming room.

1. Who you are dealing with

Red Timbers Hospitality Ltd, a New Zealand limited company, NZBN 9429046172584, of 118 Dyers Pass Road, Cashmere, Christchurch 8022, Canterbury, New Zealand, trading as Red Timbers. In these terms “we” and “the hotel” mean that company; “you” means the person making the booking or using the premises.

2. This website

The pages here describe a hotel in Christchurch, New Zealand. They are an invitation to enquire and are not an offer capable of acceptance: a booking exists when we confirm it in writing, and not before.

No transaction of any kind is completed on this website. There is no payment page, no account, no basket, and nothing that can be gambled, staked, deposited or won here. Rates, hours, menus and capacities are correct when published and change with the season; the figure confirmed in your booking letter is the figure that binds us.

The text, photographs and layout belong to us or are used with permission, and may not be reproduced commercially without written consent. Links to other sites are for convenience; what happens on them is not ours to control.

3. Staying here

Check-in is from 3pm and checkout is 11am. The room is let to the number of people on the booking; another person staying the night is charged at the extra-bed rate. The booking is personal to you and may not be resold or advertised on any platform.

Deposits, cancellation and no-shows are set out in the Booking Conditions, which form part of these terms. Rates include GST. The whole building is smoke-free and vape-free, indoors and on the terraces; a room that has been smoked in is charged NZ$350 for the deep clean and the night it cannot be sold.

Dogs stay in four ground-floor rooms at NZ$35 a night, by arrangement, and are not left alone in a room. Assistance dogs go wherever their handler goes, except the kitchen, at no charge and with no notice required.

4. Behaviour, and when we ask someone to leave

We may refuse entry, refuse service or end a stay without refund where a person is violent or threatening, is intoxicated to the point of risk, damages the building, will not stop a noise after being asked twice, brings an unlawful item on to the premises, or makes the work of our staff unsafe. That decision is the duty manager’s and it is written into the log.

Quiet hours are 10pm to 7am. This is a residential road on a hill and sound carries further here than it would in town.

5. Food, drink and the bath house

Alcohol is served under our on-licence to people aged 18 and over, and identification is asked for where there is any doubt. We refuse service to anyone who is intoxicated; that is the law and it is not negotiable at the bar.

Tell us about an allergy before you order rather than after. The kitchen cooks to it, but it is a working kitchen and cannot guarantee a wholly separate environment, and that is stated plainly here rather than implied.

In The Bowenvale Bath House: under-16s in the pools until 6pm with an adult and not in the sauna; no glass past the changing rooms; and staff may close a pool at any time for water quality, which is the one rule with no discretion in it.

6. The gaming room

The Rimu Room is open to guests and visitors aged 20 and over. Photo identification is checked at the door on every visit, whether or not you are staying in the hotel and whether or not the staff know you.

Gaming takes place inside that room and nowhere else. There is no online, remote or telephone gaming offered by this hotel, no credit is extended and no cash machine exists on the premises. The house rules of each game are displayed at the table and the decision of the duty manager on a disputed hand is final at the time; a complaint about it goes in writing afterwards under clause 10.

The venue may exclude a person from the gaming room, and any person may ask to be excluded from it. Both are dealt with under the Host Responsibility policy.

7. Your belongings

Bags are held at reception before check-in and after checkout at no charge, and at your risk. Rooms have a safe; anything of real value should be in it. Lost property is held for three months and posted back at your cost if you ask.

The car park is unattended. We watch it with a camera but we do not guard it, and vehicles and their contents are left at your risk.

8. Damage

You are responsible for damage caused by you or your party, beyond fair wear. We charge the cost of repair or replacement, plus the rate for any night the room or event space cannot be let, and we send the invoice with the evidence attached rather than a round number.

9. What we are and are not responsible for

We are responsible for injury or loss caused by our own negligence, and nothing here limits that. We are not responsible for events outside our control: earthquake, fire, flood, storm, a road closed over the hill, a power or water failure, a public health direction or an act of government. Where such an event stops us providing a booked stay we refund what you have paid for the nights not taken, and that is the limit of what we owe.

Where we are liable for something else, our liability is limited to the amount you paid us for the booking concerned.

10. Consumer law, complaints and jurisdiction

Nothing in these terms limits the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you are dealing with us as a consumer. Where you book in trade, those Acts are contracted out of to the extent the law allows.

Complaints go to the duty manager first, and then in writing to [email protected]. We answer within five working days. New Zealand law applies and the New Zealand courts have jurisdiction.
